These Terms explain your rights and responsibilities when using Pre-Trip IQ, including educational limitations, subscriptions, acceptable use, and legal terms.

Important educational disclaimer

Pre-Trip IQ is a study aid. It does not replace your current state CDL manual, professional instruction, school requirements, vehicle-specific procedures, testing-site rules, or examiner directions. No app can guarantee that you will pass.

Acceptance of These Terms

These Terms of Use (“Terms”) form a binding agreement between you and the developer of Pre-Trip IQ (“Pre-Trip IQ,” “we,” “us,” or “our”). They govern your access to and use of the Pre-Trip IQ mobile application, website, study materials, voice-practice features, support services, subscriptions, and related services collectively referred to as the “Service.”

By downloading, accessing, purchasing, subscribing to, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf.

The Service is intended for individuals preparing for commercial-driver education, testing, inspection practice, or related professional development. It is not directed to children under 13.

Educational Use and CDL Testing

No guarantee of passing

Scores, readiness percentages, lesson completion, mock-test results, and voice-practice feedback are educational indicators only. They are not an official prediction, certification, endorsement, or guarantee that you will pass any permit, skills, pre-trip, road, or licensing examination.

CDL requirements, terminology, accepted inspection wording, test sequence, vehicle configuration, scoring practices, and examiner expectations may vary by state, jurisdiction, school, testing site, vehicle, and examiner.

You are responsible for reviewing the current official CDL manual and testing requirements applicable to your location. You must follow all instructions provided by your school, instructor, testing authority, examiner, employer, vehicle owner, and applicable law.

Pre-Trip IQ is not affiliated with, sponsored by, approved by, or endorsed by the Federal Motor Carrier Safety Administration, the U.S. Department of Transportation, any state DMV or licensing authority, any CDL school, any testing center, or any examiner.

Accounts and Account Security

Some features may require an account. You agree to provide accurate information, keep your login credentials secure, and promptly notify us of suspected unauthorized access.

You are responsible for activity associated with your account unless prohibited by law. You may not impersonate another person, create an account using false or misleading information, share access in a manner that defeats subscription restrictions, or use another person’s account without permission.

Subscriptions and In-App Purchases

Automatic renewal

Auto-renewable subscriptions renew at the end of each billing period unless canceled through your Apple Account before renewal.

Price and billing

The price, billing period, trial terms, and included features are displayed before purchase and may vary by country or region.

Access

Paid access depends on a valid purchase status. Features may become unavailable after cancellation, expiration, revocation, refund, or billing failure.

Restore purchases

Eligible purchases may be restored using the same Apple Account that completed the original purchase.

Subscriptions purchased through the App Store are processed and managed by Apple. Your Apple Account will be charged according to the terms shown at purchase. You can manage or cancel an App Store subscription through your Apple Account subscription settings.

Canceling prevents future renewal but generally does not remove access already paid for through the end of the current billing period, unless Apple or applicable law provides otherwise. Deleting the app does not automatically cancel a subscription.

We may add, remove, change, or reorganize subscription offerings, provided that active subscriptions are handled according to applicable law, App Store rules, and the purchase terms presented to the subscriber.

Refunds

Apple controls billing and refund decisions for purchases made through the App Store. Refund requests must generally be submitted to Apple through its available purchase-support process.

Nothing in these Terms limits any non-waivable refund, cancellation, or consumer right available under applicable law.

Limited License

Subject to these Terms and your valid access rights, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own lawful educational and training purposes.

This license does not transfer ownership of the app, curriculum, scripts, scoring system, graphics, audio, trademarks, software, databases, or other materials.

Acceptable Use

You agree not to:

  • × copy, reproduce, distribute, sell, license, or commercially exploit protected Service content;
  • × reverse engineer, decompile, disassemble, scrape, crawl, or attempt to extract source code except where law expressly permits;
  • × bypass paywalls, subscription checks, security controls, access restrictions, or usage limits;
  • × upload malicious code, interfere with the Service, overload systems, or attempt unauthorized access;
  • × use the Service to violate law, infringe rights, harass others, commit fraud, or misrepresent qualifications;
  • × use automated systems to harvest content, accounts, results, or data without written permission;
  • × remove copyright, trademark, attribution, or proprietary notices; or
  • × use the Service while operating a vehicle in a manner that is unsafe, distracting, or unlawful.

Service Content, User Submissions, and Feedback

The Service and its original content, design, software, branding, lessons, inspection scripts, databases, scoring logic, audio, graphics, and other materials are owned by or licensed to us and are protected by intellectual property laws.

You retain ownership of information you submit, such as support messages, correction reports, and optional feedback. You grant us a limited license to use that information as reasonably necessary to operate, support, secure, and improve the Service.

If you submit ideas, suggestions, or feature requests, you agree that we may use them without restriction or compensation, provided that we do not publicly identify you without permission.

Third-Party Services

The Service may rely on or link to third-party services, including Apple, authentication providers, cloud hosting, speech-processing services, analytics, crash reporting, email, and support tools.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, conduct, security, or policies except to the extent required by law.

Availability, Updates, and Changes

We may update, modify, suspend, discontinue, replace, or limit all or part of the Service. Features may change as CDL materials, testing expectations, technology, legal requirements, and App Store rules evolve.

We do not guarantee uninterrupted, error-free, or permanent availability. Scheduled maintenance, outages, network failures, device limitations, account issues, third-party failures, or other events may temporarily affect access.

You are responsible for installing updates needed for compatibility, security, corrected content, and access to current features.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY, OR RESULTS.

We do not warrant that study materials will match every state, vehicle, school, examiner, or testing site; that voice recognition will correctly interpret every speaker, accent, environment, or phrase; that scoring will be error-free; or that use of the Service will produce a particular testing, licensing, employment, or professional outcome.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRE-TRIP IQ AND ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, LICENSORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, TESTING FEES, TRAINING COSTS, EMPLOYMENT LOSS, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE.

To the maximum extent permitted by law, our total aggregate liability arising from or related to the Service will not exceed the greater of the amount you paid for the Service during the twelve months preceding the event giving rise to the claim or fifty U.S. dollars.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be excluded.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pre-Trip IQ and its owners, affiliates, service providers, licensors, employees, and agents from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the Service, violation of these Terms, infringement of another person’s rights, or misuse of Service content.

Suspension and Termination

We may suspend or terminate access when reasonably necessary to protect users, enforce these Terms, prevent fraud or abuse, comply with law, address security risks, or respond to nonpayment or invalid purchase status.

You may stop using the Service at any time. Ending use or deleting an account does not automatically cancel an App Store subscription; subscriptions must be managed through Apple.

Provisions that by their nature should survive termination will remain effective, including intellectual-property, disclaimer, liability, indemnification, dispute, and payment provisions.

Additional Terms for Apple Users

If you downloaded Pre-Trip IQ through Apple’s App Store, you acknowledge that these Terms are between you and us, not Apple. We, not Apple, are solely responsible for the Service and its content, subject to applicable App Store terms.

Your license to use the app is limited to Apple-branded products you own or control and as otherwise permitted by Apple’s usage rules, including eligible Family Sharing or volume-purchase use where applicable.

Apple has no obligation to provide maintenance or support for the Service. To the extent any warranty exists and is not effectively disclaimed, you may notify Apple, and Apple may refund the purchase price where applicable; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing claims relating to the Service, including product-liability claims, legal or regulatory claims, consumer-protection claims, and intellectual-property claims, subject to these Terms and applicable law.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you. Use of the app is also subject to Apple’s applicable App Store terms and standard end-user license terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except where the consumer laws of your location require otherwise.

Before filing a formal claim, you agree to contact us at info@semilocator.com and provide a reasonable opportunity to resolve the issue informally.

Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought in a court of competent jurisdiction located in Mississippi. Nothing in this section prevents either party from seeking appropriate relief for intellectual-property infringement, unauthorized access, fraud, or urgent security concerns.

Changes to These Terms

We may update these Terms when the Service, subscriptions, law, technology, or business practices change. Updated Terms will be posted on this page with a new effective date. When required, we will provide additional notice.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.
